The Duty of Performance

The duty of performance means you perform the duty that you have promised on a contract that you will perform. The contract is fulfilled only when the two parties have performed their stipulated duties according to the contract. In this case, Custom Floral Arrangements, Inc., hires Bernard to order exotic flowers for its arrangements. They did this because Bernard is an expert on exotic flowers, hence they trusted and most likely agreed on the contract that he will indeed do his duty to examine that the flowers are indeed perfectly exotic as an expert.

Breach of Contract

Bernard does not examine the quality of the flowers he orders on behalf of Custom Floral. This is a breach of contract because now he is not performing the duty that they hired him to perform. By not examining the quality of the flowers, he is not fulfilling his obligation to provide exotic flowers for Custom Floral Arrangements, Inc. This breach of the duty of performance may lead to consequences such as financial losses or damage to the company's reputation.
